These Terms of Use (“Terms”) govern your access to winos.lol (the “Service”), including our website at https://winos.lol, progressive web app, and future native apps. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and alcohol

You must meet the legal drinking age in your jurisdiction and be at least 18 to use winos.lol. You confirm this when you create an account. The Service is about discovery, memory, taste, social connection, and experiences — not volume consumed. Do not use winos.lol to encourage binge drinking, underage drinking, or drinking and driving. Enjoy responsibly.

Accounts

You are responsible for your account credentials and for activity under your account. Provide accurate information. You may delete your account in Settings or by contacting support. We may suspend or terminate accounts that violate these Terms or create risk for other users.

Subscriptions and billing

  • Free is an annual subscription for one person. It is free for 30 days, then $7.98 USD per year (excluding taxes where applicable), with core features described on the pricing page.
  • Together is an annual subscription for two people. It is free for 30 days, then the price shown at checkout (currently $14.98 USD per year, excluding taxes where applicable).
  • Web purchases are processed by Paddle as merchant of record. Apple App Store and Google Play purchases, when offered, are billed by Apple or Google under their terms and refund rules.
  • Subscriptions renew automatically until canceled. Cancel anytime before renewal through the channel you used to subscribe (Paddle customer portal, App Store subscriptions, or Play subscriptions).
  • Fees are generally non-refundable except where required by law or by the platform’s refund policy.

License and intellectual property

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service. winos.lol branding, software, and content we provide remain ours. You retain rights to content you submit, and you grant us a worldwide license to host, display, and process that content as needed to operate the Service and features you enable (including public sharing when you choose Public visibility).

Acceptable use

You agree not to:

  • Violate law or third-party rights.
  • Harass, abuse, or impersonate others.
  • Upload unlawful, infringing, or harmful content.
  • Scrape, reverse engineer, or disrupt the Service.
  • Misrepresent wines, venues, or identity for fraud.
  • Use the Service to promote dangerous alcohol consumption.

AI and recognition features

Label scanning, tasting notes, and pairing suggestions may use automated systems and third-party catalogs. Results can be incomplete or incorrect. You remain responsible for how you use suggestions.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted or error-free operation.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINOS.LOL AND ITS OPERATORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Indemnity

You will defend and indemnify us against claims arising from your content, your use of the Service, or your violation of these Terms, to the extent permitted by law.

Apple-specific terms

If you obtain the iOS app from the App Store, you acknowledge that these Terms are between you and winos.lol, not Apple. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation; any claims related to the app are between you and us (subject to these Terms). Apple is not responsible for addressing claims relating to the app or your possession and use of it, including product liability, legal or regulatory compliance, and consumer protection claims. Apple is a third-party beneficiary of these Terms and may enforce them against you regarding the iOS app. In-app purchases on iOS, when offered, are subject to Apple’s media services terms.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence apply. Courts in Delaware have exclusive jurisdiction except where consumer law requires otherwise.

Changes

We may update these Terms by posting a revised version with a new date. Continued use after changes take effect constitutes acceptance.
